The New South Wales government has announced a comprehensive policy framework for data center investment, setting out conditions that developers must meet to receive streamlined planning approvals, while requiring the industry to fund the energy and water infrastructure its growth demands.
Framework Pillars and Planning Incentives
The NSW Data Center Policy Framework, released on 17 August 2026 by the Minns Labor Government, is structured around three main pillars: a set of development guidelines, regulatory reform for energy infrastructure cost recovery, and an Independent Pricing and Regulatory Tribunal review of water pricing for data center customers.
Under the guidelines component, data center proponents who comply with six core principles will receive a commitment to have their proposed developments assessed within 75 days. That accelerated timeline applies while still meeting all planning, environmental and community consultation standards.
The six principles require developers to apply world-class environmental and efficiency standards, impose no net cost to consumers and communities, fund additional supply of water and energy, enhance local community infrastructure and amenity, invest in future industries across the supply chain, and demonstrate a commitment to training and skills to support jobs.
The guidelines will be reviewed annually to ensure they remain current with advances in technology and changes in the industry. Changes are also being made concurrently to Independent Planning Commission processes to further streamline key project assessment. The Investment Delivery Authority will convene an industry collaboration event to connect energy and data center investors.
Energy Cost Recovery and Grid Planning
The second pillar of the framework addresses how electricity network costs generated by data center expansion are allocated. The NSW Government is introducing regulatory changes to ensure that data centers pay for the electricity network upgrades they require, so that extra costs are not shifted to households and small businesses.
The reforms are also designed to support more coordinated and efficient planning of the electricity network and to support implementation of the measures contained in the guidelines.
Legislation to enable these reforms has been introduced, and consultation on the detailed implementation has begun. The energy regulatory changes reflect a core concern underpinning the framework: that the rapid growth of data center infrastructure must not create a situation where the broader consumer base subsidises the grid upgrades needed to serve large industrial users.

Water Pricing Under IPART Review
The third pillar involves commissioning IPART to undertake a review of the water pricing framework as it applies to data centers. The review will consider how water pricing can reflect the full costs associated with servicing data centers, with the stated goal of ensuring other water users on the network are protected and that the impacts of drought and water scarcity are appropriately managed.
The IPART review adds a water dimension to what has historically been a predominantly energy-focused debate around data centes sustainability. The move signals that the NSW Government is treating water consumption by data centers as a resource allocation issue requiring dedicated regulatory attention.
Scale of Investment Already in the Pipeline
The policy framework comes against the backdrop of substantial investment activity already underway in the state. There are 19 data center projects valued at USD 50.3 billion currently in the State Significant Development pipeline. This is in addition to more than 60 data centers that are already operating or under construction across New South Wales.
Investment in the sector has been increasing at around 75 per cent per year on average over the three years to December 2025. The government described this growth, combined with the transformation of the state's energy system, as a key reason New South Wales has avoided recession. Data centers are cited as supporting not only home and workplace technologies but also healthcare, emergency services and banking infrastructure.
Treasurer Daniel Mookhey pointed to the structural opportunity created by the convergence of data cent,er demand and the need for renewable energy investment, stating that connecting the two means the booming digital industry can help pay for the new energy and water infrastructure that the economy needs.
Office of AI to Be Established in Cabinet Office
Alongside the data center framework, the government announced it will establish a new Office of AI within The Cabinet Office. The office is intended to strengthen and accelerate the government's response to the opportunities and challenges presented by artificial intelligence.
The Office of AI will work closely with Digital NSW, which will continue to lead coordination of government investment in the digital, cyber and data foundations needed to support AI adoption. The office will also work with public sector unions to ensure AI supports workers, strengthens capability and is implemented responsibly across the public sector.
The announcement noted that the NSW Government will continue working closely with the Australian Government and other states and territories to ensure future reforms establish a nationally coherent policy framework.
Ministerial Statements
Minister for Climate Change, Energy and the Environment Penny Sharpe said the reforms will make sure data center growth drives investment in renewable energy, while holding operators to the highest air quality standards. She framed the framework as ensuring the infrastructure needed to support data centers grows alongside demand for them.
The framework was released jointly by seven ministers, spanning the portfolios of Treasury, Customer Service and Digital Government, Energy and Climate Change, Environment and Heritage, Industry and Trade, Planning and Public Spaces, and Water, reflecting the breadth of government interests the policy is designed to coordinate.
